1. Agreement

These Terms of Service govern access to and use of the SWISHFABLE website, online store, content, customer-support features, and related services. By visiting the website, creating an account, or submitting an order, you agree to these terms and the policies incorporated by reference.

If you do not agree, do not use the services. Mandatory rights under applicable consumer law remain unaffected.

2. Eligibility and Accounts

Risk and title transfer according to applicable law and the delivery terms presented for the order. Nothing in these terms overrides a mandatory consumer rule concerning loss or delivery.

8. Returns, Refunds, and Warranty

Returns and refunds are governed by the Return & Refund Policy. Covered manufacturing defects are governed by the Limited Warranty Policy. These policies do not limit non-waivable legal rights.

You must not:

• Attempt unauthorized access, interfere with security, distribute malicious code, scrape at harmful scale, or overload the services.

• Use bots or automated means to manipulate inventory, promotions, reviews, accounts, or checkout.

When you submit a review, image, video, suggestion, or other content, you confirm that you have the right to provide it and that it is accurate, lawful, and not misleading. We may moderate or remove content that violates these terms, but we are not obligated to publish every submission.

11. Intellectual Property

The website, branding, text, graphics, product presentation, design elements, software, and other content are owned by or licensed to SWISHFABLE and protected by applicable intellectual-property laws. Limited permission is granted to access the website for personal, non-commercial shopping use.

12. Third-Party Services

Payment, delivery, social media, embedded content, analytics, and other third-party services may have separate terms and privacy practices. We are not responsible for an independent third party's acts, content, availability, or policies except where applicable law provides otherwise.

13. Promotions

Promotions may have separate eligibility, timing, product, destination, minimum-spend, redemption, and combination rules. Unless expressly stated, promotions cannot be combined, exchanged for cash, applied retroactively, or used after expiration. Abuse or technical manipulation may result in cancellation where lawful.

14. Disclaimer

To the maximum extent permitted by law, the services are provided on an “as available” basis. We do not promise uninterrupted access, error-free operation, or compatibility with every device, network, application, accessory, or third-party service.

Product performance depends on model, use, environment, connected equipment, settings, software, and other factors. Nothing on the website is medical, hearing, safety, or professional advice.

15. Limitation of Liability

To the maximum extent permitted by law, SWISHFABLE and its service providers will not be liable for indirect, incidental, special, punitive, or consequential loss, including loss of profit, data, opportunity, goodwill, or use, arising from the services or products.
